Jersey's Dean and the Silly Season.



It is often said that the month of August is the silly season for news and readers of Saturday’s Jersey Evening Post will doubtless be scratching their heads at the sight of an expensive full page advert inviting witnesses to give evidence about the conduct of the Bishop of Winchester.

The advert makes reference to an advertisement placed in the same newspaper the previous Saturday by the Bishop of Winchester inviting members of the public to offer evidence in relation to the investigation being conducted by Dame Heather Steel. The advert also published Dame Heather’s Terms of Reference (TOR).

This Saturday’s advert cites a number of the Bishop’s failings in relation to one safeguarding issue which is deemed to be disproportionate, caused widespread anxiety and hurt, and has wrongly undermined public confidence in the Church in Jersey.

Included in the failings, “is the launching of two simultaneous and uncoordinated inquiries aimed less at caring for the vulnerable and more at assaulting the constitutional relationship between Jersey and the Diocese of Winchester, which may have caused a loss of confidence in the Diocese. Some may have experienced the relentless assault on the Church in Jersey through a PR company as placing power before pastoral care.”

“Others may be alarmed at the alleged expenditure of hundreds of thousands of pounds on lawyers, public relations consultants and two extensive inquiries. The terms of reference of the Steel inquiry invite evidence from the public of inappropriate or unbecoming conduct by the clergy in relation to events of the recent past. The Bishop of Winchester is a member of the clergy. If anyone has experienced the conduct of the Bishop of Winchester as inappropriate, or unbecoming, they should write to Dame Heather Steel at heather.steel@churchofengland.org and copy it to noconfidenceinwinton@gmail.com

The advert appears to have been paid for by a group of concerned members of the laity of the Anglican Church in Jersey “who retain the highest confidence in the safeguarding record and practice of the Anglican Church in Jersey. Safeguarding provides for the care of the vulnerable, but also provides protection for those who offer that care. Courageous support is often provided by the Church for people who are deeply disturbed in the most challenging circumstances.”

Given such a powerful statement one wonders why those members of the laity did not have the courage to state who they are, who at no confidence in Winton will receive the evidence and what is its purpose? Also why should the evidence be forwarded to Dame Heather is she part of the laity, why no explanation? On reading her TOR it seems to be stretching things to claim that the Bishop’s alleged failings come within its remit.

I have questioned the Bishop’s handling of the matter ever since he suspended Jersey’s Dean Bob Key. If ever there was case of failing to plan there can be few which would surpass the Bishop’s. The advert placed by those claiming to be concerned members of the laity are no better and is akin to the pot calling the kettle black. Goodness knows what the ordinary members of the congregation up and down the country are thinking about their supposed leaders.

Those who have been following my Blogs will know that I believe the Dean and others have a case to answer, but they are entitled to expect the investigation to be conducted in an efficient and timely manner. This has not been the case and those questioning the conduct of the investigation are entitled to do so because there is ample evidence.

However what is distressing about the advert is that the concerned laity have made no mention of the real victim, that being HG, the lady whose suffered so badly at the hands of those who profess to care for the vulnerable and for giving courageous support.

Do they wish to continue turn a blind eye to those responsible for the abuse, do they wish to turn a blind eye to those responsible for HG’s arrest, detention and deportation. Do they wish to turn a blind eye to those who left her destitute in England whereby she lost her Jersey home, job and friends? Do they not care about her wellbeing and that her complaints are properly addressed?

Instead of petty squabbling among themselves, they should be united in pressing for an efficient and timely investigation and ensuring that HG receives tangible support and personal apologies. There may have been only been one safeguarding issue, but the way it has been mishandled and the fallout that followed is not down to HG but the incompetence of those tasked with the care of the vulnerable. They failed five years ago and are failing once more.

It looks to me that the advert is more about the concerned members of the Jersey Laity protecting their cosy and closed group so as to continue doing things the “Jersey Way.” Unfortunately the Bishop is playing into their hands.

  1. Sorry Bob, but I am expressing no confidence in the Bishop for what he has done, even though I am not in support of the Deanery of Jersey and their disgusting behaviour either, I know you wont publish this as it does not suit your agenda. HG

I agree, I understand, sorry Bob, I am overwhelmed because I have had no helpful support from the Church of England and Bishop Dakin has been unhelpful and I have not had the investigation explained to me and I have not been told what my part in the investigation is and basically I am bewildered and distressed by the whole thing. The investigation is a confused shambles that is only going to hurt me. The Diocese have not been helpful or kind or explained anything, they have been more cold and hurtful than anything. I wish this was over and I could go back to my blanket and forget it. HG

    5. The problem is, it is not my complaint, nor is there going to be justice, they threatened me, and are not going to take away the record that they threatened me with, therefore I am not interested in this saga.

      The Dean has been reinstated without an enquiry and basically I have no idea what I was dragged into this for. HG

HG, as far as I understand it, the purpose of the Steel/Dakin inquiry is to investigate why Bob Key did not follow established procedures in dealing with both you and the Church Warden, take good records, or involve the Safeguarding Advisor. Dame Heather's team want to talk to you to get your views, as Korris did not. I understand why you feel threatened by this but I think that's the purpose of dragging you into it. You are right in thinking that under this, there should have been more of an enquiry before letting Rev Key back to work. Bob is absolutely right, I think in that Rev Dakin has allowed himself to be bullied by the local church.

      Former Bishop Gladwin's report has the the purpose of looking at the relationship between the Jersey Church and Winchester. He will also look at any progress made in Jersey on Safeguarding Procedures and make recommendations to the Deanery, Diocese and C of E based on this.

      Bob, I'm sorry for the length of this but I am very concerned by HG's apparent confusion and I hope this help her.

Basically none of this is to do with my complaint, which is against Jane Fisher the Safeguarding Director of the Winchester Diocese, and who has managed to scapegoat everyone else and exonorate herself. HG, I have no further interest in Jersey, the Deanery of Jersey is a lost cause that no-one is going to effectively change, because the attitude runs too deep. HG

  3. Bob, what if there has not just been one safeguarding issue and the others have never come to light? do the vulnerable even have a place in Jersey churches? Was Peter Manton ever dealt with properly by the church?
    And what is wrong with the very genuine complaint against the Bishop?

    1. The case has shown how the present safeguarding policy is unsatisfactory and who knows how many other cases there have been, but have been covered up. I don’t know enough of the Manton case to comment, but one wonders what the outcome would have been had there been Blogs at the time.

      I don’t have a problem with anyone making a complaint against the Bishop and I don’t think I have ever tried to make the Deanery support HG.

      The present safeguarding policy is perfectly satisfactory. The problem is that the Dean completely failed to follow it, thinking (as he so very often does) that he knew better. He then refused to cooperate (and positively discouraged others to cooperate) with the safeguarding officer and with Jan Korris. He has to go.

    5. The safeguarding policy is not satisfactory, the problem is not just Jersey but the Diocese, and they need to remove the one person who is not fulfilling their role, Jane Fisher.

    7. It might be helpful to read the Korris Report and her comments on Jane Fisher's role.

      Korris said that Although being made by a vulnerable person, the complaints were about Church process rather than abuse. If at this transition, a fresh look had been taken by different personnel the Safeguarding Advisor could have focussed purely on ensuring that HG received pastoral support. Uncontaminated by the task of supporting the Bishop and others, and less identified with the hierarchy, JF might have been perceived by HG as taking a more neutral stance.

      It could be read that the Safeguarding Officer was protecting the backs of the Church Officers rather than being neutral. Therefore it is not surprising that HG felt she her complaints were being ignored and the process was dishonest.

    8. I agree with anonymous. My complaint against jane Fisher is very comprehensive but includes her preventing publicity about the matter while I was in Jersey, at my expense, preventing people from helping me, bullying me and having the police on me for my reaction and excusing wrongdoing and hurting me by doing so, it is a lot more comprehensive than that, and if she had not continued to harm me once I returned to the UK, then I would be housed and there would be no further police action. She prevented me being housed, drove me from my hometown of Winchester and made life hell for me, slandering me to authorities and help services to cover her and the Bishop's backs. Basically Winchester does not have adequate safeguarding as Jane Fisher is irresponsible to say the least and no-one oversees her, she was telling Scott-Joynt what to do in that matter. I agree with you, another Diocese should step in, good thinking, absolutely right. HG

  4. Bob, I read that letter on Saturday and was disgusted by its contents and the cowardness of not putting name(s) to said letter. I am a non-practising Christian and I feel ashamed that people would stoop as low as to protect the image of the church before protecting a venerable young woman who was being preyed upon by a known abuser, no less a warden of the church. HG has suffered enough and should be helped by the church weather in Jersey or England. This whole sorry affair has spiralled out of control, despite being announced, the Dean of Jersey has offered no apology to HG and has allowed this charade to continue, he should resign immediately and heads should roll.

    Like many people in Jersey, let alone further afield, I don't read the Jersey Evening Post - a paper that is nothing more than the house-journal of the local oligarchy, so didn't see the advert.

    It seems like a wholly extraordinary course of conduct. I wonder, really, how many of the Anglican laity in Jersey support the cult-like schism being lead by Philip Bailhache and his small coterie of local potentates? The impression I'm picking-up is that the great majority do not approve - but this being Jersey, are keeping their heads down in fear at crossing the local oligarchy.

    As far as the actions of the Bishop are concerned, whilst it is fair enough to suggest he - and the rest of the C of E hierarchy in the UK have made mistakes in this matter - in fairness, let us bear in mind the he and the Church at least tried to do the right thing.

    In marked and startling contrast with every Jersey based authority - and the other relevant UK based authorities such as the Secretary of State for Justice, Crown, and Privy Council - all of who have flatly resiled from their duties to ensure the protection of the vulnerable in Jersey - at least the Bishop and the C of E hierarchy have tried to do the right thing.

    If only the same could be said of any of the other relevant public authorities.

      I hope he will be more open and positive and ensure that the investigations are completed without further delay.

      Religion is as money, it is simply currency, a means for the people to be controlled by authority! If the people suddenly reject money and go back to the system of barter, the richest people in the world (those in control) become paupers overnight, they have nothing of value to anyone and lose their power.

      Religion is only another form of currency, set in place because the ancients knew that people feared death, take away the fear of death and what is there for religion to barter with?

      Time for the sheeple to awaken from their slumber, leading a good and wholesome life is no guarantee of a peaceful death!!!

    3. That's pretty much what someone in Jersey told me not long after I arrived in Jersey, he said that religeon and God was put there to control people before the police were invented. Back then I had such firm faith in God that I didn't believe him, but since then I have seen how the church of England works and I wonder.HG

    The Grouville Establishment Party seem to be making a lot of noise of late. The parish will soon have to hold a by-election for Constable of Grouville, following the sad passing of Dan Murphy. Given the links between church, parish and constable, and the current investigation, I foresee a number of people standing for all the wrong reasons.

      Tony's Blog is well worth a read and he is spot on when questioning why HG's arrest, detention and deportation is not part of either terms of reference.

      Is it because it would highlight the corrupt way it was conducted and expose the failings of the police, judiciary, legal aid system and social services. It should not be forgotten that Dame Heather is a former judge with Jersey connections and is being assisted by a senior Jersey police officer. When will Winchester wake up to the fact that they are conflicted.

  18. I understand that HG was bound over to leave the Island for a period of three years on 27th September 2010. This sentence will be spent in just over six weeks’ time, thus enabling her, I believe, to return to Jersey unimpeded should she wish to do so!!!!!!!
    This could have "interesting" implications for all concerned - unless of course some "legal reasons" are concocted to prevent her from ever setting foot on Jersey soil again!!!!!!!!!!!

I have long mistrusted the Church of England (any religion actually) and it comes as no surprise to me that now, eventually, the two obvious factions within that whole church put together,(Jersey and UK) are actually going about washing their dirty linen in public, as that is what it looks like to me and is a brilliant example of how utterly devoid of Love, Hope and Charity these people are. Plain and simple a collection of sycophants and empire builders who would stop at nothing to get their way, aided and abetted by a proven selfish judge who used ancient law in another case to rob the people of Jersey. These people will fight tooth and nail to get their way and trample over anyone weaker than they are to get their will.

    Thank you HG for proving my point and coping with your exile with dignity. I only wish I could help you but sadly there are so many people in your predicament around the world that I am not rich enough to help you all.

    I hope this religious rigmarole played out in the media will impress upon ordinary people how they don't really need religion and that the power to do evil or good is bestowed within themselves. Just be good and think good of others.

    I think we can safely say that whatever ailed the perpetrator who conducted the action that caused HG to complain in the first place needs help and guidance as well. After all it was his actions that started this whole rigmarole off initially. If found guilty of such transgressions maybe he should pay costs as no doubt his actions will eventually lead to the tax payers having to put their hands in their pockets AGAIN. Plus the fact that if it had been decided in the first place that the perpetrator, as I am led to believe, was not allowed to be in the company of women. Well this in itself was a disgraceful decision as I believe if there was any doubt that he could refrain from his temptations then he should not have been allowed to continue in the role he was playing within the church so whom soever made this decision his head should roll as well.

    2. As a result of this blog that made me aware of the 'adverts in the paper', I wonder if Bishop Tim realises that he appears to be lumping all the clergy in Jersey together. There are a few who were neutral and there are five who did indeed help me, and he should be commending those five and not leaving them wounded and defensive. I do not care what they may have done if they have felt the need to defend themselves against this sweeping investigation, they shouldn't have been put on trial with the whole Deanery. Their support for me was commendable. HG

      In previous Blogs I have questioned the Island’s ability to handle the vulnerable. HG’s case has highlighted its failings whereby it was felt that the best way of addressing HG’s complaint was to arrest, imprison for two weeks, deport her to the UK and leave her destitute. No wonder there are so many angry people.

  23. I have found the whole advert in the JEP very forceful. It reminds me of the Jersey Occupation when we would see big adverts about what we could and could not do. This advert was not the way to ask people to apply complaints or no complaints to a woman I do not know, Heather Steel? who is she, who appointed her? is this to be yet another white wash. HG my thoughts are with you.

Not only is the public to report any misconduct to an anonymous group but also to Dame Heather Steel who is supposed to be leading an "impartial" investigation into the Dean's handling of HG's complaint.

      It begs the question as to what is Dame Heather's involvement with this farce and are we likely to be told.

I agree that this group have some valid points re when is this going to end and the cost as well as not being impressed with Bishop Tim's refusal to take a lead but the bullying tone of the advert left a nasty taste in my mouth. As for Dame Heather, I shouldn't think we'll be told for a minute!

  24. Even the name Dame Heather Steel, says it all. It's all about power and control, her name is not her fault but I am afraid it does not help! She is great friends with the Bailhache's, Birts..... she is one of them so who will she side with? when what should have happened is this was dealt with in a sensitive way for HG. This is a complete insult to her. I am extremely angry at how HG has been treated. The Jersey Way, I am afraid.

  26. Dear Bob, why did the Bishop of Winchester appoint Dame Heather Steel? we all know she is friends with the Establishment, it must be someone completely independent of the Island. Please confirm. This does not make any sense, surely due diligence should have been done... does the Dame have any links with the Establishment? simple? surely? there must be someone completely independent of Jersey that can come and investigate this correctly and with no links to the Island or we end up with what happened with the Child Abuse case, a case that was not done correctly that cost the Island money and more money.... please confirm. We do owe this to HG and we owe it to the people of Jersey to get the truth.

    1. You are right to question the appointment and join the queue. Bishop Dakin seems to have lost the plot and has not given any thought to conflict. Witnesses must have the confidence in everyone appointed to any investigation. Unfortunately the Bishop is oblivious to the concerns raised.

      You are also right to expect to hear the truth, but will we receive it.

  28. I have just read the advert in the JEP, and my heart jumped! it was very threatening! I don't think this is the right way to deal with this, did Dame Heather Steel ask for it? has she been interviewed about it? what is her view? or has it been done without her knowledge, it did not feel like it. It felt like a few people from the Church felt it was their duty to do it, how paid for it? how much did it cost? answers please Bob.

    1. I don't know of Dame Heather's involvement but given that people are being asked to write to her, one assumes that she is happy to receive any information.

      It would be helpful if Dame Heather commented on the advert. As mentioned above I don't know who paid for the advert, but the whispers I am receiving is that not all of the laity are happy with the advert.

So the JEP can accept money for an advert and not do their due diligence? is this to be a complaint now to the Press Complaints Commission? we have a right to know who paid for the advert and who placed the advert? or any Tom Dick or Harry could put an advert on the JEP without the advert being fair and not one sided? I am a Church Goer and I did not give permission for it to be published? again someone is trying to speak for all of us, I can guess who it was! So yes, Dame Heather Steel did you proof read it? did you approve of it? answers please! It's got your name on it after all! are you Dame Heather Steel happy with this advert? answers to this one please. Then we will soon find out some answers to some very simple questions.

It operates in commerce, it operates in fiction, it's a figment of everybody's imagination, it does not exist!!! A 'Society' has members, what do members need to be affiliated into a private fictional club? Could it be a 'Membership'? Your birth certificate?     2. Ian, you are correct and those who have placed have every right to do so. What is interesting is no doubt some of those behind the advert are the first to moan about the contents of some of the Blogs which are published by anonymous people.

      The Advert tells us more about the laity and it is clear that some are not as courageous they would have us believe. It has also exposed the shortcomings of some members of the Church of England. That is probably what concerns the reader above.

  30. The JEP would know who is responsible for the advert because it must have cost over £1k. Not sure they would tell you if you asked who was responsible.

    I have contacted Dame Heather asking whether she was party to the advert, no reply yet.

  32. Dear Bob, that is great, Dame Heather Steel can let us know if she is happy with the advert?. It will be interesting to see if she has actually approved it. COE stands for Church of England, the rules of this Church are to take responsibility for the vulnerable. If the Jersey Establishment want their own Church they can call it COJ Church of Jersey, then they can create whatever rules they want including this Jersey made Law the Canon Law. As far as I am concerned, HG was put into prison, deported and put on a plane to the UK left alone, cold and uncared for! this is the issue, not if the COE is party to the Jersey Establishments Canon Law! As far as I am concerned COE, means Church of England! so they must lead this and they must ensure there is no conflict of interest, Bob, keep up the great work! this blog is one of the best I have read in a very long time! the support if there for you HG, hang in there x

    1. Every jurisdiction has the right to make it's own statutory laws, but no one has to consent to these statutory laws. Remember, government can only make you an offer in UCC (Uniform Commercial Code), Commercial Law, an offer for you to accept as most people do because they don't understand the deception that is going on around them. Sadly, HG consented to the offer presented to her and therefore payed the price, "Ignorance of the law is no excuse". There is a very old law maxim that goes something like this...."Let he who would be deceived, be deceived".

      As the Dali Lama once said "Learn the rules so you know how to break them properly".

    2. Ian, the records may show that HG consented to the offer that was made, but she was entitled to a fair hearing that is what concerned Jan Korris in her Report and has continued to concern me ever since I read the report but have been fobbed off by the Ch Minister and Winchester.

      HG was arrested and charged as a result of a complaint from members of the Diocese of Winchester, if the Visitation is to be credible and not a whitewash it must include whether the way the Diocese washed their hands of HG was acceptable to an organisation which is supposed to protect the vulnerable.

      It is unclear whether the arrest and deportation is included in the Steel TOR. I have sought clarification from Winchester who has ignored my request. I have also written to Dame Heather but am still waiting for a reply.

    3. Bob, our Courts are strict liability courts, once you consent to their authority you cannot win your case, save for the discretion of the Magistrate. They deliberately allow about 3% or 4% of cases a year to succeed, this is simply to maintain the illusion that there is justice in the Courts, their plausibly deniability. The notion that people are entitled to a fair and impartial hearing under Maritime Admiralty Law is simply poppycock I'm afraid.

  39. Where you have few who have power for so long, you have problems. In all parts of the world the same pattern applies. Sir Philip Bailhahce is a nice chap! but he is also a man who has been a Bailiff, a Judge and now a politician. Too many hands in too many pies! then there are the people who encourage him. This in turn makes this man a meddler in everything that happens in Jersey, a fact and one a lot of people are getting absolutely fed up with. I do believe eventually those who encourage him will see 'the light'. Sir Philip sees he is doing nothing wrong! he actually believes he is doing this all for the 'good' of Jersey. But his constant meddling in Law, in tradition, will be his downfall. He does not see another side, only his.
